Terms and conditions

1. Scope and provider

These terms apply to all orders placed with us through this website or by email:

A consumer under these terms is any natural person entering into a legal transaction primarily for purposes outside their trade, business or profession.

2. We provide contract printing services

We manufacture parts using data you provide. We do not create the design. We check your file only for printability—not whether the model is suitable, functional, safe or legally permissible for your intended use.

Advice on design suitability, material selection for a particular application or compliance with technical standards is not included unless expressly agreed in writing.

3. Contract formation

The price shown by the calculator is not an offer. It is an automatically calculated, non-binding indication based on your file. It applies to black or white material; other colours may change the price. By submitting a quote request, you ask us to make a non-binding offer.

Our offer by email is non-binding. A contract is formed only when you place an order on that basis and we confirm it by email. We reserve the right to reject orders without giving reasons.

4. Prices and VAT

All prices are final prices in euros. As a small business within the meaning of Section 19 UStG, our turnover is exempt from VAT and no VAT is shown. Any shipping costs are listed separately in the offer.

5. Rights to your models

Files and models you provide remain your property or the property of the relevant rights holders. We acquire no rights to them and use them only to fulfil your order.

By providing a file, you confirm that you are entitled to have it reproduced—because you own the rights or hold the required licence—and that printing it does not infringe third-party copyright, trademark, design or other rights.

We do not check these rights and are not required to do so. If a third party makes a claim against us alleging infringement by a print you commissioned, you will indemnify us against the claim and reasonable legal defence costs to the extent you are responsible for the infringement.

We reject orders that clearly violate applicable law, including weapons and weapon-like objects, reproductions of protected products, or objects bearing unconstitutional symbols.

6. Right of withdrawal and exclusions

No right of withdrawal for items made to your specifications. Under Section 312g(2)(1) BGB, the right of withdrawal does not apply to contracts for goods that are not prefabricated and whose production is determined by the consumer’s individual selection or specifications, or that are clearly tailored to personal needs.

This generally applies to our orders: each part is printed specifically for you after your order, using your file and your selected material, infill and colour. There is no right of withdrawal for such orders.

If, exceptionally, we supply prefabricated, non-customised goods, the following withdrawal information applies to those goods.

Withdrawal information for prefabricated goods

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party you have named who is not the carrier, take possession of the goods.

To exercise your right of withdrawal, you must inform us (Nilav, owner Aswathi Sasidharan Nair, Kurfürstenstraße 1, 80801 Munich, 3dservice@nilav.de) of your decision by an unequivocal statement, for example by letter or email. It is sufficient to send the notice before the withdrawal period expires.

Effects of withdrawal. If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except additional costs resulting from your choice of a delivery method other than our least expensive standard delivery), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal. We will use the same means of payment as you used for the original transaction unless expressly agreed otherwise; you will not be charged any fees for the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence that you have sent them back, whichever is earlier. You must return or hand over the goods without undue delay and in any event within fourteen days of informing us of your withdrawal. You bear the direct cost of returning the goods. You are liable for any diminished value only if it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

7. Liability

Responsibility for design and use. You are responsible for the design, accuracy of the reference dimensions, material choice and suitability of the part for its intended use. Additively manufactured parts are anisotropic: their strength depends on print direction, layer adhesion, material and environmental conditions, and cannot be equated with injection-moulded or machined parts.

Our parts are therefore not intended for safety-critical applications—including load-bearing parts, medical or life-support purposes, aerospace, safety-related vehicle components or permanent food contact—unless expressly agreed in writing. We are not liable for damage resulting from such use.

Scope of liability. We are fully liable for intent and gross negligence and for injury to life, body or health. In cases of ordinary negligence, we are liable only for breach of a material contractual obligation—an obligation whose fulfilment is essential to proper performance and on which you may normally rely—and only up to the foreseeable, contract-typical damage at the time the contract was concluded. Liability under the German Product Liability Act and liability under an expressly assumed guarantee remain unaffected.

8. Warranty for defects

Statutory defect rights apply. Dimensional deviations, visible layer lines, minor colour differences and support marks are inherent to the process and do not constitute defects. Please inspect the goods on receipt and report apparent defects promptly.

9. Delivery time

Production and delivery times are non-binding unless expressly stated otherwise. We will inform you promptly of delays.

10. Storage of data and files

Uploaded files and related order data are automatically deleted after 7 days unless an order results from them. Details are in our privacy policy.

11. Dispute resolution and final provisions

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer habitually resides remain unaffected. If any provision of these terms is invalid, the remaining provisions remain effective.
